We are Fundalyze. We respect your privacy and personal life, but sometimes we need your personal data. By "Personal Data" we mean information by which you can be directly or indirectly identified as a person. This definition is in accordance with the General Data Protection Regulation (GDPR).
In this statement you can read which Personal Data we use and why (Privacy Policy). You can also read how we store, protect, and process this Personal Data.
This Privacy Policy applies to our website https://fundalyze.net (Website) and our web application Fundalyze (Web App). We handle your Personal Data in accordance with the GDPR and other relevant laws and regulations in the field of the protection of Personal Data, such as the Telecommunications Act regarding the use of cookies (Relevant Legislation).
1. Processing of Personal Data
In order to offer you our Website and Web App, we process your Personal Data. In some cases, the processing of your Personal Data is necessary. For example, when we offer you our Web App or need to fulfil an agreement with you. Without your Personal Data, we cannot offer you our Web App.
2. Who is the Controller of Your Personal Data?
We are the controller for the processing of your Personal Data within the meaning of the Relevant Legislation. At the bottom of this Privacy Policy you will find our contact details and the contact details of the data protection officer.
3. Which Personal Data Do We Process, on What Legal Basis, and for What Purpose(s)?
When you use our Website and Web App, we may need your Personal Data.
We are permitted to process your Personal Data because we comply with the Relevant Legislation. We only use your Personal Data:

Payment data
Personal Data: IBAN, account holder name, direct debit data.
Purposes: To maintain the financial administration and to carry out automatic direct debits.
Legal basis: Performance of the agreement; legal obligation.
Data related to the Web App
Personal Data: Investment actions, correspondence or chat conversations with you, your questions about the Web App, IP address, location, operating system, and browser (via Help Scout).
Purposes: To perform the agreement with you, to provide you with optimal service, and to assist you with (technical) issues.
Legal basis: Performance of the agreement; consent.
Data related to our advertisements
Personal Data: Email address, data sent by your browser (browser user agent).
Purposes: To measure the number of conversions.
Legal basis: Legitimate interest.
4. Legitimate Interest
For the legal basis of legitimate interest, we make a weighing between the interests of Fundalyze on the one hand and your interests, fundamental rights, and freedoms on the other. In this assessment, it is evaluated whether the interest of Fundalyze outweighs your privacy interest.
We process the relevant Personal Data to track how many people make a request on our Website as a result of one of our advertisements (Conversion). This data is valuable to Fundalyze because it allows us to determine the effectiveness of our advertisements.
The Personal Data is generally publicly available and already known to the parties that receive this Personal Data from Fundalyze. The processing of Personal Data based on our legitimate interest therefore has no, or only a limited, impact on your privacy.
Since your interests do not outweigh those of Fundalyze, we believe that Fundalyze has a legitimate interest in processing the Personal Data. However, this assessment is subjective. Do you disagree with the processing of your Personal Data on the basis of our legitimate interest? You can always object to this with us. We will then reassess the processing of your Personal Data and possibly cease it.
5. How Do We Obtain Your Personal Data?
Personal Data received directly from you
We receive Personal Data directly from you when you visit our website, register via our website, or contact us via the contact form. Your account details can always be changed or supplemented in your settings.
6. Automated Decision-Making
We do not make use of automated decision-making.
7. How Do We Protect Your Personal Data?
We do everything we can to protect your Personal Data against loss, destruction, use, modification, or dissemination of your Personal Data by unauthorized persons. This ensures that those who have no business with your Personal Data cannot access it.
We do this by means of the following measures:
- Securing network connections with Secure Socket Layer (SSL), or comparable technology;
- Encryption of digital files containing Personal Data;
- Access to Personal Data is limited to persons who need the Personal Data.
8. How Long Do We Retain Your Personal Data?
We will not retain your Personal Data longer than we need them for the purposes we described earlier. In the event that your account is deactivated, you can restore this account within 2 years. After that, we will delete the account. We delete other Personal Data as soon as they are no longer needed for the purposes for which we process them.
9. With Whom Do We Share Your Personal Data?
Processors
We may share your Personal Data with other parties that process Personal Data on our behalf. These are Processors within the meaning of the Relevant Legislation. The Processors only use your Personal Data in accordance with our instructions and not for their own purposes. We agree with the Processors in a processing agreement that they handle your Personal Data carefully, and they only receive the Personal Data necessary to provide their service to us.

In addition, we will share your Personal Data if we have a legal obligation to do so. This is the case, for example, if the police requests your Personal Data from us.
10. Data Transfers
We will only process your Personal Data within the European Union. Outside the European Union, we only process your Personal Data if that country offers an adequate level of protection for your Personal Data. Without your consent, we will never transfer your Personal Data to countries or parties other than those mentioned above.

Our Website and Web App may contain links to other websites. We are not responsible for the content or privacy protection of these websites. We therefore advise you to always read the Privacy Policy of the relevant website.

We may amend this Privacy Policy. If we make significant changes to the Privacy Policy, we will place a notification on our Website and in our Web App together with the new Privacy Policy. If you are not registered as a user, we recommend that you consult the Website and the Privacy Policy regularly.

You have the following rights:
